Terms of service
The agreement
These terms are an agreement between you and Astel, run by Ryan (Jakarta, Indonesia), the makers of Gulp. By creating an account or using Gulp, you agree to them and to our privacy policy. If you don't agree, please don't use Gulp.
Who can use Gulp
Gulp is for everyone, including families. If you're under 13, or under the age of digital consent where you live (up to 16 in parts of the EU), you may use Gulp only with the permission of a parent or guardian. Your parent or guardian agrees to these terms for you and is responsible for how you use Gulp, including any purchases. If you're older than that but under the age of majority where you live, please use Gulp with a parent or guardian's permission too.
Profiles in the under 13 age range see no ads (Gulp has none for anyone), don't have the Share button, and we collect only what's needed to run Gulp. A parent or guardian can ask us to delete their child's data at any time by writing to [email protected].
Your account
You sign in to Gulp with Apple or Google. Please keep that account secure, because anything done through it on Gulp is treated as done by you. Choose a display name that isn't offensive and doesn't pretend to be someone else. Tell us at [email protected] if you think someone else is using your account.
Squads and being kind
Squads are for keeping each other hydrated, whether that's friends, family, flatmates or coworkers. Splashes are meant as playful nudges, never as pressure. When you use Gulp, please don't:
- harass, bully or shame anyone, including through display names, squad names, gift notes or repeated splashes;
- pretend to be someone else, or share invite links in ways meant to spam people;
- cheat the counting, for example with scripts, modified apps or false logs meant to farm drops or rank;
- try to break, overload, reverse engineer or get around the security of Gulp, except where the law allows;
- use Gulp for anything unlawful.
We may remove names, notes, squads or accounts that break these rules. You keep any rights you have in the names you create, and you let us display them in Gulp so your squad can see them.
Reporting and blocking
Gulp has no tolerance for objectionable content or abusive users. Display names, squad names and gift notes are checked against a list of words that aren't allowed, and anything that matches is turned away.
If someone's name, squad name or gift note crosses the line, you can report it in the app by long-pressing their row on Squad, or with the Report link under a gift note. You can also block anyone from the same place. Once you block someone, they can't splash you or send you gifts, you won't see their name or notes, and they aren't told. You can unblock people in Me.
We look at every report and act on it within 24 hours, by removing the content (resetting the name or clearing the note) or by removing the account of the person who posted it. You can also write to us at [email protected].
Health
Gulp is a habit app for fun and motivation. It is not a medical device and it does not give medical advice. Goals and reminders are not recommendations for how much you personally should drink. Talk to a doctor about your fluid needs, especially if you're pregnant, have a health condition, or have been told to limit fluids. Gulp never rewards drinking past your goal or drinking fast, and you should never drink more than is comfortable to keep a streak or fill a lake.
Drops and Kit items
Drops are a virtual currency you earn in Gulp or buy in packs, and Kit items are virtual looks for your Gulpal. When you earn or buy them, you get a limited, personal, non-transferable and revocable license to use them inside Gulp, and you don't own them as property. They have no cash value, can't be exchanged for money or real-world goods, and can't be sold or transferred, except as gifts inside Gulp where the app offers it. Purchases of drops are final once they're delivered, except where the law or the store's refund policy says otherwise. Some items unlock only with a streak and can't be bought. We may change prices, rewards and items, and if Gulp ever shuts down, we'll give reasonable notice in the app first. Unused drops have no value when an account is closed or Gulp ends, unless the law where you live says otherwise.
Purchases and subscriptions
All purchases in Gulp (Gulp+ and drop packs) are made through the Apple App Store or Google Play and are also covered by their terms. Prices are shown in the app before you buy.
- Gulp+ is a subscription that renews automatically each month or year until you cancel. If a free trial is offered, you're charged when it ends unless you cancel at least 24 hours before.
- You manage and cancel subscriptions in your App Store or Google Play account. Deleting the app or your Gulp account doesn't cancel them.
- Refunds are handled by Apple or Google under their policies. If a purchase is refunded, we remove what it gave you, such as purchased drops.
- Items from a monthly kit drop are yours to keep after you cancel. Other Gulp+ benefits end with the subscription period.
Nothing you pay for adds gulps, lake, streak days or rank.
Notifications
With your permission, Gulp sends reminders and squad notifications, such as when someone in your squad splashes you. You can turn each kind off in the app's settings or in your phone's settings.
Our app and art
Gulp, its Gulpals, art, animations, names and software belong to Astel and are protected by law. We give you a personal, non-exclusive, non-transferable license to use the app for your own use under these terms. If you send us ideas or feedback, we may use them without owing you anything.
Ending your account
You can stop using Gulp at any time and delete your account in the app under Me, then Delete account. We may suspend or close accounts that seriously or repeatedly break these terms, and we'll explain why where we can. When an account is closed, its drops and items go with it.
Warranties and liability
We work hard to keep Gulp running well, but it's provided "as is" and "as available", without warranties beyond those the law requires, and we can't promise it will always be available or free of errors. To the fullest extent the law allows, Astel isn't liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill, and our total liability for any claim relating to Gulp is limited to the greater of the amount you paid us in the 12 months before the claim or 50 US dollars.
Some places don't allow these limits, so they apply only as far as the law where you live permits. Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that can't be limited by law, and nothing takes away consumer rights you have that can't be changed by contract.
App store terms
If you downloaded Gulp from the Apple App Store, you and we agree that these terms are between you and Astel only, not Apple. Apple isn't responsible for Gulp or its content, has no obligation to provide maintenance or support, and isn't responsible for any claims relating to Gulp, including product liability, legal compliance or intellectual property claims. If Gulp fails to meet a warranty, you may tell Apple and Apple will refund the purchase price, if any, and has no other warranty obligation. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. You confirm you aren't in a country under a US government embargo and aren't on a US list of prohibited or restricted parties. If you downloaded Gulp from Google Play, Google Play's terms also apply.
Law, changes and contact
These terms are governed by the laws of Indonesia, and disputes go to the courts of Jakarta, Indonesia. If you use Gulp as a consumer, this doesn't take away the protection of mandatory consumer laws where you live, and you can also bring a claim in your local courts where the law gives you that right. If we change them in a way that matters, we'll tell you in the app before the change takes effect, and if you keep using Gulp after that, the new terms apply.
